Market Share Systems includes access to Maya, Claire, and other designated system features as part of the client’s monthly subscription, subject to the service allowances and fair-usage limits applicable to the client’s package.
The monthly subscription covers the MSS system, configuration, management, and any usage allowance expressly identified in the client’s package or order. Unless expressly stated otherwise, metered communication and third-party usage charges are not included in the monthly subscription.
Metered charges may include telephone numbers, inbound and outbound calls, call forwarding, call recording, transcription, text messages, multimedia messages, email delivery, carrier surcharges, A2P registration and campaign fees, AI usage exceeding an included allowance, premium AI models, and third-party applications or services. These charges may vary based on actual usage and changes in carrier, platform, provider, tax, or regulatory rates.
Market Share Systems may bill these charges as they are incurred or require the client to maintain a valid payment method or prepaid usage balance.
Features described as “unlimited” remain subject to reasonable and lawful business use, platform restrictions, carrier requirements, and the acceptable-use policies of Market Share Systems and its service providers. Excessive, abusive, fraudulent, unlawful, unauthorized, or nonstandard usage may be limited, paused, suspended, or moved to a higher service level.
Clients may not use the services for spam, purchased contact lists, unlawful solicitations, unauthorized automated outreach, resale to another business, or communications sent without legally required consent. The client is responsible for the content of its communications, maintaining required consent records, honoring opt-out requests, and complying with applicable communication and privacy laws.
When reasonably possible, Market Share Systems will notify the client before imposing a service restriction or making a material change to the client’s service level. Restrictions imposed by a carrier, platform, regulator, or third-party provider may occur without advance notice.
To the fullest extent permitted by law, Market Share Systems shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of this website or reliance upon its contents.
We may update these Terms of Service at any time without prior notice.
Continued use of this website after changes are posted constitutes acceptance of the revised terms.
These Terms shall be governed by and interpreted in accordance with the laws of the State of Missouri, without regard to conflict of law principles.
